Every Diwali the bonus lands, the amount is lower than expected, and someone in the office group asks if the gift voucher will be taxed too. Owners running a business in the AI era also carry the payroll, gift and GST costs covered below. For 2026-27, the first year under the Income-tax Act, 2025, some of these limits have changed.
Is Diwali bonus taxable? Yes, as salary
Short answer: yes. A Diwali bonus paid in cash or by bank transfer is salary. It is taxed at your slab rate, and your employer deducts TDS on it under section 392 of the Income-tax Act, 2025. Gifts and vouchers in kind follow a separate limit: they are tax-free only while their total from your employer stays below ₹15,000 in the tax year.
Section 15 of the Act charges to tax any salary due to you, or paid to you, in the tax year under the head “Salaries”. A bonus, ex gratia payment or festival incentive is salary for this purpose. There is no festive exemption and no amount below which a cash bonus becomes tax-free, under either tax regime.
What about a festival advance?
A festival advance can be taxed in two different ways, and the answer depends on how your employer structures it. Ask payroll which one applies.
- Advance salary (adjusted against future pay): it is taxable in the year you receive it, and it is not taxed again when the salary falls due (section 15(1)(b) and 15(3)).
- Loan: the principal is not income. The perquisite is the interest you save, and the 2026 Rules give it nil value where your employer’s loans total ₹2,00,000 or less.
Diwali gift voucher tax: the limit for gifts from your employer
Rule 15 of the Income-tax Rules, 2026 (notified 20 March 2026) values a gift, voucher or token from your employer at nil if the total in the tax year is below ₹15,000. At ₹15,000 or more, the full amount becomes a taxable perquisite, not just the excess. The old Rule 3 used ₹5,000, and you will still see that figure online. Even the Income Tax Department’s perquisites page still shows it. It is the pre-April 2026 number.
- The ₹15,000 is a yearly total across every gift or voucher, including Diwali, birthday and work-anniversary gifts. Gifts to your household members count too.
- The rule covers gifts, vouchers and tokens, not cash. Cash is salary.
- Depends: the Rules do not define “voucher”. Practitioners commonly treat a prepaid card that works like cash as salary, so confirm with your employer how it is reported.
Example: Rohit gets a ₹6,000 hamper at Diwali and a ₹7,000 voucher on his work anniversary. The total is ₹13,000, so the perquisite is nil. A further ₹3,000 voucher in March takes the total to ₹16,000, and all ₹16,000 becomes taxable. At a 30% slab plus 4% cess, that is ₹4,992 of extra tax.
Gifts from family and friends: what’s exempt
Gifts from your employer are salary. Gifts from everyone else fall under “Income from other sources” in section 92. If you receive money without consideration from non-relatives and the total in the tax year exceeds ₹50,000, the whole sum is taxable. Property such as gold or jewellery is tested the same way, at fair market value.
Section 92(3) exempts gifts from a relative, gifts on your marriage, and gifts by will or inheritance. “Relative” covers your spouse, siblings, your spouse’s siblings, your parents’ siblings, your parents, grandparents, children and grandchildren, your spouse’s parents and other lineal relatives, and the spouses of these people. Cousins and friends are not on the list.
Example: Your parents give you ₹2 lakh for Diwali: exempt, with no limit. A friend gives ₹30,000 and a colleague gives ₹25,000 in the same tax year: the non-relative total is ₹55,000, so the whole ₹55,000 is taxable.
Employer side: GST, ITC and deductibility
GST on gifts to employees
Under Schedule I of the CGST Act, gifts from an employer to an employee up to ₹50,000 in a financial year are not treated as a supply. Above that, a free gift made in the course of business can attract GST on the employer. GST law does not define “gift”. Perquisites given under the employment contract, such as a contractual bonus, are outside GST under CBIC Circular 172/04/2022-GST.
Input tax credit
Section 17(5)(h) of the CGST Act blocks credit on goods disposed of by way of gift. It has no ₹50,000 threshold, so on a plain reading, GST paid on staff hampers is a cost even when the gift itself is outside GST. Credit on vouchers is less clear, so take advice before claiming it.
Income-tax deduction
Section 34(1) of the Income-tax Act, 2025 allows expenditure laid out wholly and exclusively for the business, so staff bonuses and gifts are normally deductible. Section 34(3)(b) disallows a benefit whose acceptance breaches the recipient’s conduct rules, which matters mainly for gifts to officials. Bonus paid to employees is deductible under section 32(a), but section 37 allows it only in the year it is actually paid. If it is paid after year-end, it counts for that year only if paid on or before the due date for filing the return under section 263(1).
TDS on bonus: why your in-hand amount is lower
Section 392(1) requires your employer to deduct tax at the average rate on your estimated income for the year. A bonus raises that estimate, so the bonus month often shows a sharp jump in bonus TDS. The slabs are in our guide to Income Tax in India.
Example (new regime): Priya earns ₹14 lakh a year. After the ₹75,000 standard deduction her taxable income is ₹13.25 lakh and her tax is ₹81,900 with cess. A ₹1 lakh Diwali bonus lifts taxable income to ₹14.25 lakh and tax to ₹97,500. The extra ₹15,600 is 15% plus 4% cess, so about ₹84,400 of the ₹1 lakh is hers after tax. Payroll systems differ on whether the extra is deducted in the bonus month or spread over the remaining months.
- A bonus that pushes taxable income past ₹12 lakh can cost you the Section 156 rebate, with marginal relief just above the line.
- TDS is not the final tax. Check your Form 26AS and AIS, and claim a refund when you file if too much was deducted.
- Arrears, such as 8th Pay Commission arrears, are salary too and are taxed in the year you receive them.
Gift type vs tax treatment: comparison table
| Type | Employee’s tax | Employer: GST and deduction |
|---|---|---|
| Cash bonus or ex gratia | Fully taxable as salary; TDS under section 392 | Deductible salary cost if paid by the section 37 deadline; contractual bonus is outside GST |
| Gift hamper or product from employer | Nil if the year’s gifts and vouchers total below ₹15,000; full value taxable at ₹15,000 or more | Not a supply up to ₹50,000 a year per employee; ITC blocked; expense deductible |
| Brand-locked voucher | Same ₹15,000 limit | Same GST position; ITC on vouchers unsettled |
| Gift from a relative | Exempt, no limit | Not applicable |
| Gift from a friend or colleague | Exempt up to ₹50,000 a year in total; above that, all of it is taxable | Not applicable |
| Festival advance | Advance salary: taxed when received. Loan: nil if loans total ₹2,00,000 or less | Payroll policy decides |
What is settled and what is not
- Confirmed in the law: a cash bonus is salary; the ₹15,000 cliff; the ₹50,000 limits for non-relative gifts and the GST proviso; no value threshold in section 17(5)(h).
- Conditional: prepaid cards (voucher or cash?); festival advance (loan or advance salary?); GST and ITC on vouchers.
